Please read these terms carefully before purchasing our products or services.

By purchasing from us or accessing our site, you accept and agree to these Template Terms & Policies in full.

You must be at least 18 years old to enter into this Agreement.

 

Parties

This Agreement is entered into by Natalie Smikle hereinafter referred to as the “Service Provider,” and the purchaser of digital products or services, hereinafter referred to as the “Customer” (together referred to as the “Parties”).

Payments are processed securely via third-party providers (such as Stripe or PayPal). By completing a purchase, the Customer also agrees to comply with the terms and conditions of the relevant payment processor. The Service Provider is not a party to that separate agreement.

 

Overview

These Template Terms & Policies set out how the Customer may access and use templates provided by the Service Provider, including supplementary resources such as video tutorials, workbooks, checklists, emails, and other materials.

“Business Day” shall mean a day other than Saturday, Sunday, or a public holiday in the UK.

 

Offerings

The Service Provider’s offerings include:

Non-tangible Squarespace templates

Digital products

Supplementary resources (videos, guides, workbooks, checklists, emails, AI-assisted knowledge base)

Optional services such as installation and restyling

The Service Provider may modify or discontinue products at any time without notice, and prices may change.

 

1)  Payments

1.1  Payments are securely processed through third-party platforms.

1.2  The Customer must provide complete, accurate, and current purchase details.

1.3  By purchasing, the Customer agrees that:

Any payment information provided is true and complete.

Charges incurred will be honoured by the Customer’s bank, credit card company, or e-commerce provider (e.g. PayPal).

The Service Provider is authorised to charge the chosen payment method.

The Customer remains liable for charges even if the payment method is declined.

1.4  If payment is not received within seven (7) Business Days, the Customer’s access may be suspended or terminated, but the Customer will still be liable for the full cost.

 

2)  Intellectual Property and Licensing

2.1  Ownership.

All intellectual property rights in the templates and supplementary resources remain the sole property of the Service Provider. Purchase does not transfer ownership.

2.2  Licence Grant.

The Customer receives a limited, non-exclusive, non-transferable licence, subject to the following:

·       Single-Use Licence: One template per website. Additional licences are required for additional sites or client projects.

·       Modifications: The Customer may customise templates for their own or their client’s needs.

·       Restrictions: The Customer must not:

o   Duplicate templates for multiple websites.

o   Share, resell, sublicense, or distribute templates or code.

o   Claim the design as entirely their own.

o   Share access to tutorials or the AI-assisted knowledge base with unauthorised users.

2.3  Client Projects.

Each client project requires its own licence.

2.4  Liability
The Customer is responsible for ensuring their use of templates complies with all applicable laws (copyright, data protection, accessibility, etc.). The Service Provider is not liable for non-compliance.

 

3)  Exclusive Design Credit

The Designer reserves the right to apply a design credit in the footer of the final website. Removal of the Designer’s design credit does not mean the Designer is surrendering their design credit to any other party.

 

4)  Template Access

4.1  The Customer receives lifetime access for the life of the product, including updates.

4.2  The Service Provider may discontinue offerings with 30 days’ notice.

4.3  Access may be interrupted due to maintenance or technical issues.

4.4  The Service Provider is not liable for refunds or damages caused by downtime.

 

5)  Permitted Use

5.1  Both Parties have the right to share photos of products and services for marketing and advertising purposes.

5.2  The Service Provider may use information related to these Terms and Policies for the purpose of marketing and advertising their services, provided that the Customer’s confidential information is not disclosed. The Service Provider may also use information related to these Terms and Policies for the purpose of improving their services and developing new products.

5.3  If the Customer submits content (comments, testimonials, photos, videos), the Customer grants the Service Provider a royalty-free licence to use it for marketing. The Service Provider may attribute content but is not obliged to do so.

 

6)  Confidentiality & Data

6.1  The Service Provider may collect personal data (name, contact, billing, demographics, preferences).

6.2  The Service Provider will take reasonable steps to secure data, but submission is at the Customer’s own risk.

6.3  Confidentiality does not apply to information that is public, already known, independently developed, or lawfully obtained.

 

7)  Lawful Purposes

The Customer agrees to use the templates lawfully and not in ways that infringe others’ rights, encourage crime, or constitute fraud. Breach may lead to suspension and reporting to authorities.

 

8)  Policies

8.1 Installation Policy

(i)    Templates are delivered within two (2) Business Days of purchase.

(ii)  Installation service (if purchased) is usually completed within five (5) Business Days of receiving required access.

(iii)  Installation includes transfer of the demo site, tutorials, and configuration of demo styles.

(iv) Excludes migration of Customer content, third-party plugins, or additional customisation.

(v)  Delays may occur (e.g. force majeure, backlog). The Service Provider will notify the Customer, but no compensation is due.

(vi) The Customer is responsible for backing up their site. The Service Provider is not liable for lost content during installation.

 

8.2 Support Policy

(i)    Includes thirty (30) days of email support from purchase.

(ii)  Covers delivery, tutorials, template bug fixes, and issues caused by Squarespace updates.

(iii)  Excludes Squarespace platform issues, SEO, domains, third-party tools, copy, imagery, hosting, or design strategy.

(iv) Support requests should be submitted via [email protected]. Responses aim for within two (2) Business Days.

 

8.3  AI-Assisted Knowledge Base

(i)    Provided as a complementary service.

(ii)  For licensed users only.

(iii)  Information may not always be fully accurate.

(iv) The Service Provider may modify or discontinue the service without notice.

(v)  The Service Provider is not liable for reliance on AI-provided information.

 

9)  Template Reskin Package

9.1 Limited to colours, typography, images, and content changes.
9.2 Covers up to 6 core pages styled.
9.3 Completed within seven (7) Business Days once all materials are provided.
9.4 Includes one week of technical support after handover.
9.5 Up to three (3) revision rounds included.
9.6 Dormant projects (30+ days inactivity) may require a £200 reactivation fee.

 

10) Refund Policy

10.1 Due to the digital nature of products, all sales are final and non-refundable.

10.2 Services are non-refundable once commenced.

10.3 If the Service Provider cancels before commencement, the Customer will be refunded.

10.4 Errors in delivery (e.g. wrong file) will be resolved promptly if the Customer contacts the Service Provider at [email protected].

 

11) Disclaimers

11.1Legal & Financial Disclaimer
The Service Provider’s offerings are for educational purposes only. They are not a substitute for professional legal or financial advice. The Customer should seek professional guidance.

11.2 Earnings Disclaimer
The Service Provider does not guarantee specific outcomes or earnings. Results depend on the Customer’s effort and circumstances.

11.3 Testimonials Disclaimer
Testimonials reflect individual experiences and do not guarantee similar results.

 

12) Limitation of Liability

12.1 The Service Provider’s liability is limited to the amount paid by the Customer.

12.2 The Service Provider is not liable for indirect, incidental, or consequential losses.

12.2 Assumption of Risk
The Customer accepts full responsibility for their decisions and actions in using the   offerings.

12.3 Errors & Omissions
While the Service Provider aims for accuracy, no guarantee is made that all information will always be up to date or error-free.

12.4 Third-Party Content
The Service Provider may reference or link to third parties. The Service Provider is not responsible for their content, terms, or privacy practices.

 

13) Force Majeure

The Service Provider will not be liable for delays or failures caused by circumstances beyond its control such as: an act of God (fires, explosions, earthquakes, hurricane, natural disasters, flooding, storms or infestation), pandemic, lockdowns, governmental order, war, Invasion, terrorism, Act of Foreign Enemies, embargo, or other Hostility (whether declared or not), or any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

 

14) Indemnification

The Customer agrees to indemnify the Service Provider against claims, damages, or losses arising from misuse of templates, breach of these terms, or reliance on third-party content.

 

15) Release of Claims

The Customer releases the Service Provider from claims relating to loss of revenue, goodwill, confidential data, or service interruption resulting from use or misuse of the offerings.

 

16) International Users

The offerings are operated from the UK. If accessed from abroad, the Customer is responsible for compliance with local laws.

 

17) Modification

The Service Provider may amend these terms without notice. The current version on the Service Provider’s site overrides all previous versions.

 

18) Termination

18.1 The Service Provider may terminate the Customer’s licence and access if the Customer breaches these terms or becomes disruptive.

18.2 On termination, no refunds will be due, and all obligations (e.g. payments, confidentiality, liability) continue to apply.

 

19) Severability

If any provision is held invalid, the remainder of the Agreement remains enforceable.

 

20) Governing Law & Jurisdiction

These Terms and Policies shall be governed by and construed in accordance with the laws of England and Wales, and any disputes, controversies or claims arising out of or relating to this Agreement – subject to Clause 21 – shall be subject to the exclusive jurisdiction of the courts of England. The Parties waive any right to bring legal action in any other jurisdiction and agree to submit to the exclusive jurisdiction of the courts of England.

 

21) Alternative Dispute Resolution
Mediation: If a dispute arises under this Agreement, the Parties agree to first submit the dispute to a mutually agreed-upon mediator in London, England. Any costs and fees other than solicitor fees associated with the mediation shall be shared equally between the Parties. If the dispute is not resolved within thirty (30) days after referral to the mediator, the Parties agree that the matter may be resolved in a court of law as set out in Clause 20. If any court action is necessary to enforce these Terms and Policies, the prevailing party shall be entitled to reasonable solicitor fees, costs, and expenses in addition to any other relief to which that party may be entitled.
